REGARDING THE SANCTIONS APPLIED BY THE OPERATOR
The participant - buyer of the Energy Exchange (hereinafter referred to as “the Exchange”) ENEFIT POWER AS (hereinafter referred to as “the Buyer”) has filed dated 17-03-2025, 21-03-2025, 25-03-2025 complaints (hereinafter referred to as “the Complaints”) to the Operator of the Exchange, BALTPOOL UAB (hereinafter referred to as “the Operator”). The Complaints state that the Exchange participant - seller Metsahake OÜ (hereinafter referred to as “the Seller”) has been repeatedly supplying biomass product SM3 along with prohibited impurities such as metal, plastic, glass, stones, etc. in it to the Buyer with, thus breaching in the following agreements entered into between the Buyer and the Seller via Exchange.
The Buyer has also submitted to the Operator data confirming the presence of prohibited impurities in the biomass supplied by the Seller under the aforementioned agreements, along with evidence that the Seller had been repeatedly warned that the supply of contaminated biomass would not be tolerated in the future.
In the Complaints, the Buyer requested the Operator to:
• Restrict the Seller’s ability to conclude agreements with the Buyer for the purchase and sale of the biomass product SM3 on the Exchange until 30-06-2025;
• Annul the agreements previously concluded between the Buyer and the Seller regarding the purchase and sale of the biomass product SM3, the execution of which has not yet been completed.
It is important to note, that stones, glass, metal, plastic and etc. cannot be used for the production of the SM3 specification wood chips. Nonetheless accidental and unintentional, the non-compliance with the latter rule constitutes a harsh breach of the obligations of the Seller acting as a participant to the Exchange. Moreover, in line with Annex 1 to the Conditions of Trade in Biomass Products , chemically treated wood products and (or) by-product are prohibited from being included into SM3 specification wood chips traded in the Exchange.
It should also be noted that by the Operator's decision No. SD-250044 dated 30-01-2025 titled „Regarding the Sanctions Applied by the Operator“, the Seller Metsahake OÜ had already been restricted from concluding Exchange transactions for the purchase and sale of the biomass product SM3 with the Buyer ENEFIT POWER AS until 12-02-2025 (inclusive).
The Operator, having evaluated the information provided, in accordance with the Clauses 6.3.1 1), 6.3.1 4), 6.3.4 1), 6.3.4 4), 6.3.4 5), 6.3.6 and 7.2. of the Regulation of the Energy Exchange :
1. Restricts the ability of the Seller, Metsahake OÜ, to conclude purchase-sale transactions of product SM3 (wood chips) with Enefit Power AS in the Exchange until June 30, 2025 (inclusive).
2. Warns the Seller, Metsahake OÜ, that if a violation of the contractual execution rules in the Exchange is suspected or repeatedly confirmed, the Operator, considering the nature, scope, possible consequences, recurrence, and impact of the violation on trade in the Exchange, has the right to terminate Metsahake OÜ's existing contracts in the Exchange. The Operator also reserves the right to impose liability for damages (losses) caused by Metsahake OÜ, including claims from Exchange participants and/or third parties for compensation, if such damages (losses) or claims arise directly or indirectly from Metsahake OÜ’s failure to properly fulfill its contractual obligations

REGARDING THE SANCTIONS APPLIED BY THE OPERATOR
The operator of the Energy Exchange (hereinafter referred to as the Exchange) BALTPOOL UAB (hereinafter referred to as the Operator) has received a complaint from the Exchange participant (hereinafter also referred to as the Buyer), dated January 28, 2025 (hereinafter also referred to as the Complaint), concerning the quality of the product SM3 (wood chips) supplied by another Exchange participant, the seller Metsahake OÜ (hereinafter referred to as the Seller). Along with the Complaint, the Buyer provided recorded evidence regarding the Seller’s delivery of non-compliant biomass under the purchase-sale agreement concluded on 03-12-2024 (hereinafter referred to as the Contract). The delivered biomass contained prohibited impurities such as metal, plastic, glass, stones, etc. The Buyer also indicated in the Complaint that during the period from 20-01-2025 to 26-01-2025, due to the evident non-compliance of the delivered biomass with the quality requirements specified in the Contract, the Buyer refused to accept the delivered biomass from seven transport vehicles.
On 2025-01-13, the Operator was included in the correspondence between the parties regarding the delivery of non-compliant product SM3 (wood chips) The correspondence indicated that during the first week of supply, the Buyer refused to accept biomass delivered by five transport vehicles, and during the second week, by nine transport vehicles. The Seller was also informed that if it fails to comply with the contractual requirements regarding the composition and quality of the biomass supplied through Exchange agreements, the Buyer would request the Operator to apply sanctions against the Seller.
It is important to note, that stones, glass, metal, plastic and etc. cannot be used for the production of the SM3 ( wood chips). Dėl VII etapo 31 zonos hidraulinių bandymų nuo birželio 7 d. iki birželio 13 d. Vilijampolės mikrorajonas bus hidrauliškai atskirtas nuo Kauno m. šilumos tiekimo sistemos. Dėl VIII etapo 10 zonos hidraulinių bandymų nuo birželio 14 d. iki birželio 20 d. Šilainių mikrorajonas bus hidrauliškai atskirtas nuo Kauno m. šilumos tiekimo sistemos. Šilumos gamyba ir tiekimas šiose hidrauliškai atskirtose zonose (planuojamas poreikis 1764 MWh) galimas tik iš AB "Kauno energija " Inkaro katilinės.

Informuojame, kad Operatoriui gavus informacijos iš biokuro pirkėjo ir Radiacinės saugos centrui patikrinus UAB „Gretvitos kompostas“ biokuro aikštelėje, Elektrinės g. 22, Elektrėnai (toliau – Prekybos aikštelė), sandėliuojamą biokurą, nustatytas ne homogeniškas atskirų biokuro mėginių užterštumas 137Cs radionuklidu, kuris nežymiai viršija 30 Bq/kg ribą. Atsižvelgiant į Radiacinės saugos centro rekomendacijas Operatorius įpareigojo UAB „Gretvitos kompostas“
tiekiant biokurą biržos dalyviams iš Prekybos aikštelės, pateikti radiologinio tyrimo dokumentus kiekvienai biokuro siuntai, t. y. autotransporto krovimo metu pardavėjo sąnaudomis privalo būti paimamas biokuro ėminys biokuro užterštumui 137Cs radionuklidu nustatyti, o tokio tyrimo rezultatai - pateikiami pirkėjui biokuro pristatymo metu.
Toks Operatoriaus Įpareigojimas UAB „Gretvitos kompostas“ taikomas iki bendrovė pateiks Operatoriui įrodymus, kad Prekybos aikštelė yra išvalyta, o joje esantis biokuras yra išgabentas ar panaudotas kitais tikslais.
